Introduction
This Dispute Resolution Agreement ("Agreement") is a part of the Terms of Service for Rim Locals ("we," "our," or "us"). By using our services, you agree to the terms outlined in this Agreement, which governs the resolution of disputes that may arise between you and Rim Locals. This Agreement applies to all users of the platform.

1. Agreement to Arbitrate

You and Rim Locals agree that any disputes, claims, or controversies arising out of or relating to the use of Rim Locals, including but not limited to breach of contract, tort, or violations of applicable laws, will be resolved through binding arbitration, rather than in court, except for claims that may be brought in small claims court.

2. Arbitration Process

The arbitration will be conducted by a neutral third-party arbitrator, chosen by mutual agreement, under the rules of the American Arbitration Association (AAA) or another recognized arbitration organization. The location of the arbitration will be in the jurisdiction in which Rim Locals operates, or at another mutually agreed-upon location.

• Arbitrator's Authority: The arbitrator will have the authority to resolve any claims and disputes, including determining the scope of this Agreement. The decision of the arbitrator will be final and binding, subject only to limited appeal rights under applicable law.
• Arbitration Fees: The costs of arbitration, including the arbitrator’s fees, will be split equally between the parties, unless otherwise ordered by the arbitrator.

3. Mediation

Before pursuing arbitration, you and Rim Locals agree to attempt to resolve any dispute through informal mediation. If the dispute cannot be resolved through mediation, the matter will proceed to arbitration. Mediation is not a required step, and parties may proceed to arbitration directly if both agree.

4. Waiver of Class Action

By agreeing to this Dispute Resolution Agreement, you and Rim Locals waive any right to pursue disputes on a class-wide basis. Neither you nor Rim Locals may participate in any class action, collective action, or representative proceeding related to the dispute. All claims must be brought in an individual capacity.

5. Exceptions to Arbitration

Notwithstanding the requirement to arbitrate disputes, either you or Rim Locals may seek relief in a court of law for:

• Claims for injunctive or equitable relief related to intellectual property rights.
• Claims related to the enforcement or validity of your or Rim Locals' intellectual property rights.

6. Jurisdiction and Venue

If for any reason a dispute is not resolved through arbitration or mediation, the exclusive jurisdiction and venue for any claims not subject to arbitration will be in the courts located in the jurisdiction in which Rim Locals operates. You agree to submit to the personal jurisdiction of those courts for any such actions.

7. No Effect on Other Rights

This Dispute Resolution Agreement does not limit or affect any rights you or Rim Locals may have under applicable law. Nothing in this Agreement should be interpreted to deny you access to remedies that are legally available outside of this Agreement.

8. Severability

If any provision of this Dispute Resolution Agreement is found to be invalid or unenforceable, the remainder of the Agreement will remain in full force and effect.

9. Modification of Agreement

Rim Locals reserves the right to modify this Dispute Resolution Agreement at any time. Changes to this Agreement will be posted on the website, and the updated version will take effect immediately upon posting. Your continued use of Rim Locals constitutes your acceptance of the modified Agreement.
